We have learned of an incident involving the vessel CMA CGM LIBRA, a Malta flag, 2009 built, 131,332 gt, fully cellular containership, which ran aground after departure from the port of Xiamen. The salvage companies Shanghai Salvage and Svitzer have both offered to provide salvage assistance under the terms of an Lloyd's Open Form of Salvage Agreement, although Shipowners are currently considering the possibility of obtaining services on commercial terms. The vessel is carrying general containerised cargo and is due to continue to Europe after calling at Hong Kong. The local authorities are monitoring the situation and it is expected that they will insist that a contract and refloating plan are agreed without delay. The vessel is understood to be supported only at her bow and stern, so there is a concern that her hull will begin to suffer from sagging with the consequent risk of further damage and there could be a real risk that she might break her back. She is understood to be laden with significant amounts of heavy fuel oil for her voyage. It is also possible that the Shipowners will opt to declare General Average. Thus in addition to providing salvage security, there may also be a requirement for GA security to be provided by cargo and container interests. Please note that cargo and container interests are not under any duty to provide GA security until the vessel/cargo reaches destination and we would strongly recommend that advice should be sought as regards the proposed wording of any GA Guarantees and Bonds before these are provided to the shipowners. This is particularly important since it is likely the vessel will be unable to complete the voyage and an alternative vessel/s will be required to take the sound cargo to destination. We have learned of a recent incident involving the vessel MOONDANCE II, a 55,000dwt Bulk Carrier on a voyage from Kalimantan, Indonesia to Rizhao in Shandong Province, China. The ran aground on a coral reef about 20 miles from Kalimantan as a result of which a Lloyds Open Form salvage contract was signed on 5th January 2011. It is anticipated that the services will require a lightening operation to barges of significant quantities of the loaded cargo of Coal. As a result, Salvage Security will be required and General Average will likely be declared. The circumstances of the grounding will require to be investigated with a view to determining nature and cause. It is also more than likely that General Average security will be sought before authorisation is given to release cargo interests. The vessel suffered an engine failure 80 nautical mile south west of Sanya and began drifting. A distress message was sent out and South China Sea Resue Bureau were dispatched and took the vessel under tow. The extent and terms of the salvage services have yet to be determined, or whether General Average may be declared. We have learned of a recent incident involving the vessel GREEN VALLEY, a 1995 built, 9,600gt Fully Cellular Containership, on a feeder service between Malaysia, Singapore, Bangladesh and India and the vessel TIGER SPRING, a 2006 built, 8,971gt Fully Cellular Containership also on a feeder service between India and Sri Lanka. The vessels were in collision at Hoogly Point near Kolkata early in the morning of November 23rd 2010. Pilots were on both vessels at the time of the incident and as a result of the collision, GREEN VALLEY suffered damage to her bow, the forepeak was holed and pumps are in place to cope with the ingress. TIGER SPRING is also indicated to be holed. Early indications were that one of the vessel was badly damaged and was sinking. Whilst enquiries are ongoing to determine the extent of damage to ships or cargoes, as well as the extent, if any, of salvage services that may have been rendered, photos of the TIGER SPRING examined by our representatives locally indicate that there are definitely containers damaged on deck. It is has however yet to be determined if General Average will be declared. As a result of the collision with containership Odessa Star, whilst entering Izmat Bay to proceed to Evyap Port to load and discharge, CMA CGM VERLAINE sustained serious damage to her port shell section, resulting in a list up to 6 degrees. The crew undertook pumping operations and the casualty was moved to Evyap Port anchorage. In order to effect repairs to the vessel the entire cargo has been discharged at Yilport container terminal and the vessel shifted to Tuzla shipyard on 13th April. As a result, the vessels owners have now declared General Average and details of the security requirements, as well as the final disposition of the cargo are presently awaited. W.E. Although it has yet to be determined if salvage services are being carried out under Lloyds Open Form contract, given the nature of the incident it is likely that security will be required for Salvage and that General Average will be declared and appropriate security required in this respect. The vessel was seized by pirates approximately 250 nautical miles off coast of Oman on 12th May, reportedly carrying a cargo of Iron Ore and with crew of 19 Filipinos, 2 Greeks, one Ukrainian and one Romanian. In similar manner to previous piracy incidents, there is likely to be a ransom demand from the pirates in due course. At that point it is anticipated that the Owners of the vessel will declare General Average and there will be calls for GA security and potentially for advance contributions toward ransom costs. If you are involved with cargo on board we would recommend that you refrain from offering GA security without giving serious consideration to the wording of the security documents and any call for payment on account should be resisted. Furthermore, the circumstances of the hijacking may warrant investigation in order to determine whether the Owners may have contributed in any way to the incident, which may give rise to defending a GA claim. The vessel is said to have suffered an engine breakdown on 8th January 2012 in the North Pacific. Engineers are presently surveying the vessels engines and a tug has been in attendance. It is anticipated that a salvage services will be provided in the near future and in which case there may be a requirement for Salvage security. In addition, a General Average declaration may also be anticipated and for which security will also be required. In this respect we welcome insurers instructions to represent their cargo interests on board, as well as taking care of security requirements as they may arise. The usual course of events is that the Norwegian Shipowners will initiate communication with the pirates to determine the extent of ransom demand. The vessel suffered main engine problems 120 miles off Algeciras and was towed there, arriving 13th December. The engine is in the process of being dismantled. The scope of the salvage services have yet to be determined, however, given the nature of the incident and the repairs being effected, it may be anticipated that General Average may be declared and in those circumstances it is also more than likely that General Average security will be sought before authorisation is given to release cargo interests, either from Algeciras or final destination. The vessel has 24 crew on board of Egyptian, Pakistani, Bangladeshi and Ghanaian nationalities. The cargo is unknown at this stage. It is reported that the vessel was boarded by armed pirates, who took control in the early hours within the Internationally Recommended Transit Corridor. Whilst additional information relating to the hijacking and possible ransom demand has yet to be determined, it is likely that General Average will be declared and if we may be of assistance in this respect, including for the provision of General Average security on behalf of cargo, we would welcome your instruction. The vessel ran aground 2 miles offshore. The entire crew were safely evacuated but the ship is said to have suffered structural damage in the fore body and is in danger of breaking up. Salvage operations by Chinese maritime authorities are underway, including pollution control measures. You may be aware of a recent incident involving the vessel NOBLE HAWK, a 2007 built, 31,238gt Bulk Carrier, on a voyage from Singapore and Indonesia to China, having previously called at India, carrying 54,000mt Nickel Ore. The vessel is said to have grounded in a remote part of Indonesia. Salvage services are being rendered by Svitzer Salvage under Lloyds Open Form terms. At least one Hold of the vessel is said to have suffered ingress of water, which is the cause of concern regarding the stability of the vessel following refloating, due to the liquefaction of the nickel ore cargo when it becomes saturated. On the basis of LOF salvage, Salvage Security will be required following completion of services. In addition, General Average will almost certainly be declared. The circumstances of the grounding will also require to be investigated with a view to determining the cause. It should also be anticipated that Salvage and General Average security will be sought before authorisation is given to release cargo. The vessel is carrying more than 2000 loaded containers The vessel suffered a fire in an engine room, approximately 50 mile west of Goa. The crew were evacuated to sister vessels in the vicinity. Salvage services were rendered, although it is understood not to be under LOF terms and the fire was extinguished. There is said to be no pollution or loss of containers. Even though there would not appear to be the requirement for salvage security in this instance, it is anticipated that General Average will be declared and salvage costs will be incorporated into the assessment of GA. The circumstances of the fire will require to be investigated with a view to determining nature and cause and also to identify responsibility for the fire. It is also more than likely that General Average security will be sought before authorisation is given to release cargo interests. UPDATE 1ST APRIL 2010 Further to our casualty report of 27th March, we have now received confirmation that General Average has been declared. The vessel is currently off India, but she might be allowed into an Indian port as she is without motive and electrical power. Salvors were appointed under a daily contract, and there is no separate Salvage Security requirement. We are not aware of any declaration of GA but Five Oceans are rendering Salvage services, agreed under LOF, but not yet signed; the CORAL SEA FOS is currently on her way from Colombo, with the intention of towing the casualty to Singapore, where she should arrive by mid-March. She is presently stopped due to engine problems. The nationality of the crew is unknown. You may be aware of the recent incident involving the vessel Thor Nexus a 1989 built, 15520 gt Bulk Carrier on a voyage from Jebel Ali, UAE for Bangladesh, having previously loaded a cargo of Urea Fertiliser in Saudi Arabia. The vessel was attacked by pirates and hijacked 450 nautical miles north-east of the Island of Socotra in Indian Ocean. You may be aware of a recent incident involving the vessel MAERSK IDAHO, a 2000 built, 50,698gt Fully Cellular Containership, on a voyage from Colombo, Sri Lanka to Salalah, Oman, Jebel Ali, Saudi Arabia, Aqaba, Jordan, Algeciras, Spain, and U.S. Ports. The vessel went aground at Km 101, whilst transiting the Canal with the southbound convoy. The terms of Salvage services are presently undetermined nor when refloating operations will be undertaken. Whether or not there will be any requirement for salvage security in this instance remains to be seen. Nevertheless General Average is a likely prospect, given the extent of potential costs that may be envisaged and that General Average security will be sought. In those circumstances we offer the services of W.E. Cox Claims Group to assist with the provision of security and to investigate the circumstances of the grounding with a view to defending any GA claim.
